Terms of Use
The Terms and Conditions that follow set forth the basic rights and obligations between you (“you”, “your” or “yourself”) and OnClassical (“our”, “us”, “we”, or “onclassical.com”) and governs your use of our Internet-based Music Service together with all information, content, products, materials and services made available to you through onclassical.com by us (the “Service”).
Access to onclassical.com, and any actual or attempted use of the Service, including, without limitation, any transmission, exchange of information or communication associated with the services, constitutes your agreement to be bound by and comply with the Terms and Conditions herein, including, without limitation, our Privacy Policy and any other policies, rules and provisions which are described, linked or otherwise referred to and form a part of this Agreement.
If you are not yet 18 years old or if, for any reason, you do not accept and agree to ALL the Terms and Conditions of this agreement, please discontinue to use the Service in any manner.
The Service
Introduction. OnClassical is an Internet record Label that sells recordings of its own realization or recordings ceded by the Artist for the purpose of OnClassical. Recordings are shared and exposed as musical Albums (Albums) in digital audio format, compressed or not, and posted on the web sites of onclassical.com. OnClassical currently provides the Service for downloading music. The Service consists of single downloading of a single Album at a time whereby, for a fee – which is not the cost of connection via an internet provider - and subject to certain limitations as described herein, you are granted specified download rights to our catalogue of music Albums.
Music samples. You do not have to pay to listen to (and download) our streaming MP3 audio files.
Duration of the Service. Duration of Service lasts 10 days once you have paid for access and downloading of a single Album. A panel (at www.onclassical.com/ecm/redownload.htm) will show you the list of your current purchases and the remaining time to complete the dowload of each single Album purchased. You will have 10 days to download (or redownload or to complete your downloading) a single Album for which you have paid. Once the 10 day period has expired, the Album may no longer be downloaded without an additional payment.
Non recurrence of OnClassical. Publications of Album and texts (all), images or other on OnClassical are not bound to recurrence, but are published at the sole discretion, formality and timing of OnClassical.
Modification
Change of the Agreement. We may revise or modify any of the aspects of our Service and/or any of the Terms and Conditions contained in this Agreement, from time to time, at our sole discretion. We will not notify you of any such changes other than by posting them on this page. By using this site you also agree to check this page periodically to make sure you continue to agree with the Terms and Conditions herein. All changes will be effective upon the date of the publication on this page (“effective date”).
Future products or services. If any new products or services become available, they will be considered a part of the Service and your use of them will be governed by the Terms and Conditions of this Agreement unless otherwise specified.
Website Changes and Modifications. OnClassical maintains the right to add, delete, modify or change the files, links, and contents of its websites. These alterations may be made at any time without advance notice.
Privacy
It is very important that you read and understand the OnClassical Privacy Policy. This policy can be found at http://www.onclassical.com/texts/legal/privacy.htm and applies to your usage for your benefit. This policy is subject to change at any time without notice.
(Non-)Registration and Cookies. Registration is not requested for access to onclassical.com and its Services. All you have to do is to activate your browser cookies so as to permit our transaction program to run. Session Cookies used on this site avoid the need of other computer technology that could otherwise compromise discretion afforded during navigation by users and would not allow us to acquire users' personal data. OnClassical will not guarantee the redownload function and/or the ability to accede to our other Services in the event that cookies have been disactivated or deleted. In other words: you have to maintain active cookies, without deleting them, for at least the period you use to download and redownload. In particular the redownload function works correctly if associated with the same browser you used when you purchased the Album.
Browsers. OnClassical.com is optimized for use with Explorer 5.5, Mozilla 5.0 and Firefox 1.5. OnClassical cannot guarantee that it will work correctly with different browsers.
Private use. OnClassical makes and will make reasonable efforts to keep the OnClassical Site operative. By using the Service, You acknowledge and agree that you may only use the Service and all the downloaded files and/or make copies of any file obtained through the Service, and with the full respect of the law, for your own personal use.
No robots. You are not allowed to use any automated system, robots, download accelerators or similar software for the selection or downloading of files.
No deep-links. You must not, under any circumstances, provide links to our media from your or any website (deep-links) or link to our email address/es. You are instead welcome to link to our page's addresses (http://www.onclassical.com suggested).
Fees and Payments
Shared with Artist! OnClassical will pay half of the fees you paid to the relative Artist.
Fees. By entering for the Service you agree to pay the fee designated for the Service you select in accordance with the price you choose (from 4.50 euros per album - 6.00 euros suggested - up to 16 euros).
Payments. Payment made with major credit cards are accepted by OnClassical (currently: VISA, MasterCard and American Express). Your card issuer agreement governs your use of your designated card in connection with the Service, and you must refer to that agreement and not this Agreement to determine your rights and liabilities as a cardholder. You, and not OnClassical, are responsible for paying any amounts billed to your credit card by a third party which were not authorized by you.
External fees (if any). Fees, charges and payments hereunder do not include paying any taxes, duties, government levies or other charges (if any) imposed by a taxing or other regulatory authority relating to your use of the Service for which you are solely responsible. You are solely responsible for arranging payment for any and all additional or premium charges for your use of any third party services via the Service.
Termination
We may restrict, suspend or terminate your use of the Service immediately and without notice or liability, if you violate, breach or fail to comply with this Agreement in any way, without limits to our possibility of having recourse to whatever rights or remedies are available for our defence.
Intellectual Right
OnClassical web site and logo, texts, Service program and whatsoever present at www.onclassical.com (www.onclassical.com, www.onclassical.net, www.onclassical.org) and all its relative pages are, except where differently indicated, the property of OnClassical by Alessandro Simonetto, D.I.
Personal use. You may use and play everything from the onclassical.com web site and from its Services for your personal, non-commercial, use only. You agree not to reproduce, retransmit, distribute, disseminate, sell, broadcast, make available to third parties or circulate the Album downloaded through the Service to anyone, or to exploit any such content for commercial or non-commercial purposes without the express prior written consent of OnClassical.
Other. You agree not to engage in any conduct that violates or infringes those intellectual property rights. You further agree that engaging in any activity with the aim of circumventing the site’s protection and methods is a copyright violation punishable to the full extent of the law. You acknowledge that OnClassical retains exclusive ownership of the Service and all intellectual property rights associated therewith.
User Indemnity
You shall indemnify and defend OnClassical and hold OnClassical harmless from and against any and all costs, liabilities, losses, damages and expenses arising out of any claims, actions, suits, or proceedings of any kind from any third party claim relating to your breach of the Terms and Conditions of this Agreement or to another person whose uses the Service on Your computer.
Disclaimer
The Service is provided on an “as is” and an “as available” basis. We do NOT make, and hereby disclaim, any representations or warranties regarding the use of the Service at www.onclassical.com, and the products (Albums and other) offered by OnClassical. OnClassical makes NO warranty, express or implied, that the Service will be adequate or meet your requirements and/or your access to/and use of the Service will be uninterrupted or error-free, and/or free of viruses, not common or malicious codes, or other harmful components, and/or otherwise secure.
OnClassical makes no warranty with respect to the accuracy or effectiveness of the OnClassical website, including content therein, nor any errors or problems of any kind that may arise from the website. OnClassical shall not be responsible for losses, damages, costs, or expenses of any kind resulting from the use of the Service.
External Sites
In the event that you choose to utilize services of one of our affiliated or linked sites, OnClassical will not be held responsible for disputes or issues that may arise between you and one of these parties.
